BOSTON, MA (WBZ-AM) -- State Police confirmed to WBZ NewsRadio1030 that divers recovered the bodies of two missing fishermen after their boat sank off the coast of Nantucket earlier this month.
Fisherman Michael Roberts, 44, and Jonathan Saravia, 32 went missing after their boat, The Misty Blue, a 69-foot commercial fishing vessel based out of New Bedford, took on water on December 5.
They say that the first body was recovered at 10:30 a.m. and the second at 4:20 p.m.
"We offer our deepest condolences to their families. I have no further information to relay." said David Precopio, State Police Spokesperson in a statement.
The Coast Guard, State Police, Barnstable County Sheriff, Dennis Fire Department and two commercial fishing vessels conducted an initial search and rescue once an emergency ship in distress call was received.
The ships's captain Eric Arabian, 44, and a crewmen, Colby McMullen, 22, were rescued.
According to The Standard Times of New Bedford, MA Matthew Lyons, a crew member from Fairhaven, MA filed a $1.5 million lawsuit in U.S. District Court in Boston against Sea Harvest Inc, The Misty Blue owners.
The suit was filed less than a month before the vessel overturned and sank.
Court documents show Lyons claimed that on Sept. 15, as a result of negligence by the captain and crew of the vessel, he was seriously injured. Lyons says he is seeking damages, citing “unseaworthy” condition — a legal term used to describe any unsafe condition occurring on a vessel.
